EU AI Act Enters Enforcement: What General Counsel Must Operationalise Now

EU AI Act enforcement entered force on 2 August 2025. The EU AI Office is operational, GPAI obligations are binding, and penalties reach €35 million or 7% of global turnover. General counsel of any organisation serving EU customers now have approximately ten weeks to operationalise Defensible AI governance before the August 2026 high-risk-systems deadline, and fifteen months to remediate legacy models. Functions still moving operate under a controlled timeline. Functions that did not stand up an active programme remediate under enforcement.

The EU AI Act entered force 1 August 2024 and reached its most consequential milestone on 2 August 2025, when the EU AI Office became operational and General-Purpose AI (GPAI) obligations took effect. Penalties reach €35 million or 7% of global turnover. The functions that move now build the Defensibility Posture the August 2026 deadline will assess; the functions that wait remediate under enforcement at GDPR-precedent multiples of pre-deadline cost.
